Terms of Service

1. Agreement

By accessing or using the ABCAxis platform or signalthree.com (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms are a legal agreement between you and Signal Three Consulting Inc. ("Signal Three," "we," "us," or "our"). If you do not agree, do not use the Services.

2. Description of Services

ABCAxis is a software-as-a-service platform designed for Alcoholic Beverage Control (ABC) agencies to manage establishment inspections, compliance records, enforcement activities, and operational scheduling. Access to ABCAxis is granted on an organization basis. Individual user accounts are created by authorized organization administrators.

3. Account Access and Authorized Use

Access to ABCAxis is limited to employees and authorized agents of contracted organizations. You agree to:

• Keep your login credentials confidential and not share them with others
• Use the platform only for lawful, work-related purposes within the scope of your organization's contract
• Promptly notify your administrator if you believe your account has been compromised

Signal Three reserves the right to suspend or terminate access for any user found in violation of these Terms or applicable law.

4. SMS Notifications and Consent

By activating your ABCAxis account, you consent to receive operational SMS text messages from Signal Three on behalf of your organization. These messages are limited to:

• On-call duty assignments and transfers
• Schedule changes affecting your upcoming assignments

Message Frequency: Message frequency varies based on operational activity, typically 1–5 messages per month.

Message and Data Rates: Standard message and data rates may apply. Signal Three is not responsible for any charges imposed by your mobile carrier.

Opt-Out: You may opt out of SMS notifications at any time by replying STOP to any message. You will receive a single confirmation and no further messages will be sent. To re-enable notifications, contact your organization's administrator.

5. Data and Confidentiality

All data entered into ABCAxis — including establishment records, inspection reports, and enforcement records — remains the property of your organization. Signal Three acts as a data processor on behalf of your organization and will not access, disclose, or use your organization's data except as necessary to operate and maintain the platform.

You agree not to enter personally identifiable information beyond what is required for legitimate enforcement purposes under your organization's policies and applicable law.

6. Prohibited Conduct

You agree not to:

• Attempt to gain unauthorized access to any part of the platform or its underlying infrastructure
• Reverse engineer, decompile, or copy any part of the Services
• Use the platform to transmit malicious code, spam, or unlawful content
• Interfere with the integrity or availability of the platform

7. Service Availability

Signal Three makes commercially reasonable efforts to maintain platform availability. We do not guarantee uninterrupted service and are not liable for downtime caused by factors outside our reasonable control, including third-party infrastructure failures, maintenance windows, or force majeure events.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Signal Three shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services. Our total liability in connection with the Services shall not exceed the amounts paid by your organization in the three months preceding the claim.

9. Changes to Terms

Signal Three may update these Terms periodically. We will notify organizations of material changes via the platform or email. Continued use of the Services after the effective date of any changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Wake County, North Carolina.
